HANDLING OF PERSONAL DATA

Protection of your privacy is very important to us. We have therefore fundamentally designed our web presence such that it can be used anonymously. Information that we receive and store during your visit to our website is used by us exclusively for internal purposes and to improve the design of the web pages. We only store the IP address transmitted by your web browser for a period of time in order to detect, limit and eliminate faults or errors (e.g. attacks on our servers). However, the storage ends after one month at the latest.  After expiry of this period we delete or anonymise the IP address. We use the IP address exclusively in a way that is strictly for the specific purpose of the aforementioned security. Further information about processing of the IP address can be found below under the point on "usage data".
 

USAGE DATA / LOG FILES

When you visit our website, so-called usage data are stored temporarily as a log on our web server for statistical purposes, to improve the quality of our web pages.

This data set comprises:

  • The site from which the file was requested
  • The name of the file
  • The date and time of the request
  • The data volume transmitted
  • The access status
  • The description of the type of web browser used
  • The operating system
  • The IP address of the requesting computer (see above, anonymised in accordance with the aforementioned period)


LEGAL BASIS

DATA PROCESSING FOR CONTRACTUAL PERFORMANCE: TRAVEL BOOKING / BOOKING REQUEST

We process the following data in accordance with art. 6 par. 1 lit. b GDPR for the purpose of contractual performance:

  • Title
  • Salutation
  • First name, Last name
  • Address data (sending of invoice and travel documents)
  • Date of birth / age of all travellers
  • Telephone number of the main traveller/contact person (for short-term contact in case of changes)
  • E-mail address (sending a summary of the booking data)
  • Credit card data (as a guarantee for your reservation)
     

This also includes the associated customer care.

We send your booking confirmation to your specified e-mail address. Furthermore, in connection with your booking and in addition to the booking confirmation, you receive additional e-mails from us, which are matched to your journey, with promotional content for our own similar products. You can object to this mailing at any time by sending an e-mail datenschutz@dertouristik.com without incurring costs other than the transmission costs in accordance with the basic rates. After receiving your objection we will stop the transmissions immediately.

If necessary, personal data are passed on to the companies that are involved with processing this contract, e.g. service providers such as hotel operators, airlines or financial institutions for payment processing.

The data required for the contractual performance are held in accordance with statutory retention periods (e.g. German fiscal code (Abgabenordnung - AO), German commercial code) and deleted after expiry of these periods.


DATA PROCESSING ON THE BASIS OF CONSENT

If you have issued separate consent, processing is performed accordingly on the basis of art. 6 par. 1 lit. a GDPR. Your consent can be revoked at any time without affecting the legality of the processing completed to date. If consent is revoked, we stop the corresponding data processing.

PARTICIPATION IN LOTTERIES, COMPETITIONS OR SIMILAR ACTIVITIES

On our website we offer from time to time the possibility to take part in competitions or contests and similar actions. Personal data such as e-mail address, name, address and, if necessary, other data necessary for the campaign may be collected and processed in order to carry out these campaigns. All personal data provided in the context of such a promotion will be used exclusively for the processing of the promotion, e.g. for the determination, notification or sending of the prize. The data will be deleted after the action is completed.

 

DATA PROCESSING TO FULFIL LEGAL OBLIGATIONS?

We process your data in order to be able to fulfil our legal obligations (e.g. from fiscal and commercial law). The data processing is performed on the basis of art. 6 par. 1 lit. c GDPR. The data are deleted after expiry of the required retention periods.


DATA PROCESSING TO PROTECT LEGITIMATE INTERESTS?

We process your data for our own marketing purposes (e.g. promotional approach, market analysis). The data processing is performed on the basis of art. 6 par. 1 lit. f GDPR. The data are deleted after expiry of the specified retention periods. You have the right to object to the data processing. DATA PROCESSING TO PROTECT VITAL INTERESTS?

We process your data in individual cases in order to protect your vital interests, in order e.g. to be able to provide emergency forces with an evacuation list in emergency situations. The data processing is performed on the basis of art. 6 par. 1 lit. d GDPR. The data are deleted after expiry of the required retention periods.


DATA PROCESSING FOR DIRECT ADVERTISING

We process your data for the purpose of direct advertising, in particular for sending e-mails tailored to your trip with information and offers relating to your trip. Data processing is carried out on the basis of art. 6 par. 1 lit. f GDPR and in the interest of informing you about new products and services. Each customer has a separate right of objection to such processing, the exercise of which leads to the termination of processing for the purpose of direct marketing. If data is stored exclusively for direct advertising, it will be deleted after the objection has been raised.


DATA RECIPIENTS

We transmit your data to third parties (e.g. to service providers such as hotel operators, airlines or financial institutions for payment processing) only if transmission authorisation under data protection regulations is in place. We can also transmit your data to external service providers (e.g. IT service providers, companies that destroy or archive data, print service providers), which - strictly subject to instructions - support us with the data processing as part of order processing.

Data processing here may also take place outside the EU or EEA. As an appropriate guarantee for the legality of these data transmissions, among other things we have formed EU standard contracts with the order processor in accordance with art. 46 par. 2 lit. c GDPR.

We will market your personal data neither to third parties nor otherwise.
 

REFERENCE TO A RIGHT OF OBJECTION AGAINST DIRECT ADVERTISING

WEBSITE ANALYSIS AND TRACKING

USE OF COOKIES

When visiting our website, it may be that information is saved on your computer in the form of cookies, for example to be able to identify preferences of visitors and accordingly design the website optimally. This helps us e.g. to make navigation easier and achieve a high level of user friendliness.

GOOGLE ANALYTICS

This website uses Google Analytics, a web analysis service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereafter "Google"). Google Analytics uses cookies, which are stored on your computer and allow analysis of your use of this website. The information generated by the cookie about your use of this website is generally transmitted to a server of Google in the USA and saved there. We would like to point out that the code "gat._anonymizeIp();" has been added to Google Analytics on this website to guarantee anonymised collection of IP addresses (so-called IP masking). In the case of activation of IP anonymisation on our websites, your IP address is truncated in advance by Google within member states of the European Union or other contracting states of the agreement on the European Economic Area.

ADOBE ANALYTICS

By using the web analysis tool Adobe Analytics (Omniture) we create pseudonymous user profiles to improve the design and usability of our website and to optimize the booking process. Adobe Analytics (Omniture) uses cookies (text files) that are stored on your computer. This enables us to obtain anonymous information about the surfing behaviour of our website visitors, to analyse the use of our website and to make the website even better for you as a customer. The information generated by the cookies is transferred to a Adobe server in Ireland and stored there in strict compliance with EU directives. We also ensure that the IP address is anonymized before geolocation. For this purpose, we perform IP anonymization in the server settings by default. After the geolocation has been recorded, the IP address is rendered unrecognisable by (x.x.x.x) and is no longer available. The IP address will not be used for any other purpose or passed on to third parties.
Adobe helps us process the information we collect quantitatively, generates reports on website activity, and provides us with starting points to improve the browsing experience for you as a customer. ADOBE TEST & TARGET

From the company Adobe we use the software Test & Target. The software enables us to perform so-called A/B tests or multivariate tests on the website. For this purpose, the software controls a different variant (e.g. with different design and contents) compared to the original version of the website. CONTACT FORMS

On our website there is also the possibility to get in contact with us on various topics. Examples of this are forms for booking enquiries, callback requests, feedback, special customer requests etc.

Depending on the background of the contact, various data are requested in the form. Personal data such as title, first name, surname and e-mail address are usually mandatory for the purpose of establishing contact and personal address. If you use a form for a callback or appointment enquiry, additional data such as telephone number can also be requested. For travel enquiries or questions about existing processes, you can also enter your booking or invoice number.
 

DATA SECURITY

To protect your data from unwanted access, we use an encryption method on our booking pages. Your details are then transmitted from your computer to our server and vice versa via the Internet using SSL encryption.
 

RIGHTS OF THE PERSON CONCERNED

People concerned have the right to information from the person responsible about the personal data concerning them and to correction of inaccurate data or to deletion if one of the reasons specified in art. 17 GDPR applies, e.g. if the data are no longer required for the purposes pursued. The right also exists to limit the processing if one of the conditions specified in art. 18 GDPR applies, and the right to data portability in cases of art. 20 GDPR. If data are collected on the basis of art. 6 par. 1 lit. e or lit. f, the person concerned has the right to object to processing at any time for reasons arising from the specific situation.
We will then no longer process the personal data unless compelling legitimate reasons for the data processing exist verifiably, which outweigh the interests, rights and freedoms of the person concerned or if the processing serves to assert, exercise or defend legal claims.


RIGHT TO APPEAL TO A REGULATORY AUTHORITY

Every person concerned has the right to appeal to a regulatory authority if the person is of the opinion that the processing of the data concerning the same infringes data protection regulations. The right to appeal can be exercised specifically to a regulatory authority in the member state of the residence of the person concerned or the place of the suspected infringement.
